On January 27th, our firm had the pleasure of serving as guest speaker at Kings Isle, an active lifestyle community, located in Port St. Lucie West, for their “Eye Opener” morning program. With approximately 60 residents in attendance, Attorney Shaun W. Wiedrick presented an informative discussion on estate planning and elder law. This was our 3rd presentation at Kings Isle in recent years.
The presentation covered the importance of having a comprehensive estate plan in place, including the role of last will and testaments, the differences between wills and living trusts, and strategies to avoid probate. Mr. Wiedrick discussed the benefits of properly titling real property, including transferring property into a trust or utilizing an enhanced life estate deed (commonly known as “Lady Bird” deeds) to name remainderman beneficiaries, while reserving important rights and control over the property and avoiding probate court. He also explained that while Lady Bird deeds can be an effective planning tool, they are not appropriate in every situation, and careful consideration must be given to whom is named and whether that strategy aligns with the client’s overall estate plan.
Additional topics included the importance of proper beneficiary designations on financial and retirement accounts, planning for potential incapacity to help avoid guardianship proceedings, Medicaid planning versus Medicare, long-term care considerations, and tax planning strategies.
The program concluded with an engaging question-and-answer session, allowing residents to address specific concerns and gain further clarity on these important planning issues.
